1. -This agreement does not grant any license software. You are prohibited from, directly or indirectly: decompile, disassemble, or otherwise attempt to discover the source code or object code or underlying structure, ideas or algorithms that are found on or through the Services, software , documentation or data related toServices(The "Software") remove any proprietary notices or labels of theServicesor theSoftware, Modify, translate or create derivative works from or based on the Services or the Software, nor copy, distribute, transfer, assign or transfer any rights of the Services or Software.

2. -If you use theServicesin any country of the European Community, the prohibition to modify, translate, decompile, disassemble or create derivative works based on the Services or the Software does not affect the rights granted by the legislationDirectivethe EC Council on Legal Protection of Computer Programs.

3. -You represent, undertake and warrant that you use the Services only in complianceEuropean Directive on Privacyand other applicable laws (including but not limited to, those policies and laws governing the "spam", privacy, obscenity or defamation). You agree not to access or use mailing lists from third parties in preparing or distributing unsolicited email to third parties. Similarly, you agree to indemnify and hold harmless DATUMSTORE of any responsibility for any damage, loss, resolution or disbursements (including, but not limited to, costs and attorney fees for a reasonable amount) related to any claim or action law arising from a supposed violation of thisAgreementor otherwise related to your use of DATUMSTORE. DATUMSTORE Although not required to control the content that you distribute, or use of theServices, DATUMSTORE can, and may remove any such content or prohibit the use of our services if you believe may violate (or is alleged violation of) the above conditions.

4. -TheServicescan only be used for legitimate purposes.It prohibits the transmission or the solicitation of any material that violates the laws of the European Community or any other law in your country or region. This may include material that is obscene, threatening, harassing, defamatory or involving the violation of intellectual property laws or intellectual property rights of others.

Cancellation

1. -DATUMSTORE can cancel a customer's access to your account, without refund, detects a violation of any terms specified in Section"Restrictions and Responsibilities".

2. -DATUMSTORE delete all your information on file after 90 days of cancellation. All sections of thisAgreementwhich by their nature should continue in force after the cancellation of this, continue to apply, including (without limitation) those relating to ownership, warranty disclaimers and liability limitations.

Warranty Disclaimer

1. -THE USE OF THE SERVICES AND ANY USE BY YOU,INCLUDING TAKE ANY ACTION AS A RESULT OF SUCH USE SHALL BE AT YOUR OWN RISK. DATUMSTORE NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES. THE SERVICES ARE PROVIDED "AS IS" AND DISCLAIMS ANY WARRANTY DATUMSTORE, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS AND NONINFRINGEMENT.

2. -DATUMSTORE NO MORE THAN NECESSARY QUALITY ASSURANCE AGREEMENT SET FORTH IN SECTION 11 OF THE "SERVICE AGREEMENT".

Your sole and exclusive remedy for any failure or failure of services shall be for DATUMSTORE take commercially reasonable steps to improve or correct the services offered.

Limitation of Liability

1. -TO THE EXTENT PERMITTED BY LAW, DISCLAIMS ANY RESPONSIBILITY DATUMSTORE UNDER NO LEGAL THEORY, TORT, CONTRACT OR OTHERWISE, TO YOU OR ANY OTHER PERSON WITH RESPECT TO ECONOMIC DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL , USE OR CONSEQUENTIAL, EVEN IF DATUMSTOREHAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR ANY CLAIMS OF THIRD PARTIES. IN THE EVENT THAT, NOTWITHSTANDING THE ABOVE, BE DECLARED DATUMSTORE LIABLE TO YOU FOR DAMAGES OF ANY KIND, AND REGARDLESS OF ITS KIND (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE) DATUMSTORE LIABILITY TO YOU SHALL BE LIMITED TO REFUND THE AMOUNT PAID FOR THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DAMAGES IN KIND OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY
